Raymond Felton’s Gun Case

Back in 2008, New York Giants wide receiver, Plaxico Burress, got arrested on felony possession of a weapon charges after accidentally shooting himself in the thigh.  Earlier this week, New York Knicks point guard, Raymond Felton, was arrested on similar charges for allegedly possessing a handgun and threatening his wife with it.

These two high-profile cases have caused the public to focus on just how strict the New York gun laws have become.  People who possess unlicensed weapons of any kind, or even empty ammunition feeding devices of certain sizes, run the risk of being arrested and prosecuted to the fullest extent of the law.  If you’re caught with a loaded weapon, you’ll be charged with Penal Law section 265.03, Criminal Possession of a Weapon in the Second Degree, a class C violent felony, which carries a 3.5 year minimum jail sentence and a 15 year maximum sentence!  If this has happened to you, call me, Michael Dreishpoon, Esq., immediately (718-793-5555) to discuss what defenses are available.
